Overtime Pay For Emails Prompts Lawsuits

WESTCHESTER COUNTY, N.Y. -- The proliferation of smart phones and PDAs has prompted a new rash of legal action from employees claiming they aren't being paid overtime for the time spent checking and sending emails after work hours, according to reports.

Large companies like Verizon and T-Mobile have been sued by employees, but both companies have said they are acting within the confines of the law, ABC News reported. 

What has become clear, is that the Fair Labor Standards Act, which was signed into law in 1938, may need some updating to keep with the times, ABC News said.
