Dustin P. Averill, 22, of Concord, was spotted sitting in a car in the store’s parking lot off 80 Independent Way around 11:30 a.m. Monday, Oct. 31, by a sheriff’s deputy who had been dispatched to investigate a report about two suspicious males
The men were reportedly walking around the lot looking into vehicles, police said.
Averill and an unidentified companion were sitting in the car when approached by Deputy Sheriff Christopher Tompkins, police said.
Thompkins determined that Averill was wanted in New Hampshire in an unrelated larceny case, police said.
Police said Averill was in possession of an item stolen from Home Depot.
After interviewing store security personnel, the officer charged Averill with petit larceny, a misdemeanor.
Averill was also charged with third-degree criminal possession of a controlled substance, also a misdemeanor, after the officer said he found drugs on him.
Averill was arraigned at the Town of Carmel Justice Court on behalf of the Town of Southeast and sent to the Putnam County Correctional Facility on $1,500 cash bail. He is to appear in court on an undetermined date.
If found guilty of the misdemeanor charges, Averill could face up to a year in jail and a fine of up to $1,000 for each charge, police said.
Police did not say what happened to the other man.
